Terms and Conditions & Participant Agreement

Event: Cinematography Masterclass with Mr. Ravi Varman

Organizer: Third Eye Cinematics LLC

By registering for this Masterclass, you ("Participant") agree to be bound by the following Terms and Conditions set forth by Third Eye Cinematics LLC ("Organizer").

1. Workshop Registration

By registering for the Third Eye Cinematics cinematography masterclass, you agree to these terms and conditions. Registration is completed upon submission of the registration form and payment of the workshop fee.

2. Payment & Fees

  • Full payment is required to secure your spot in the workshop
  • All fees are in USD and subject to applicable state and local taxes
  • Payment must be made through our authorized payment processor
  • Workshop fees are non-transferable except as stated in our refund policy

3. Event Cancellation & Refund Policy

3.1. Participant Cancellation

  • More than 30 days before the event: Full refund minus a 5% processing fee.
  • 15–30 days before the event: 50% refund.
  • Within 14 days of the event: Non-refundable. Registrations may be transferred to another attendee with prior approval.

3.2. Organizer's Right to Cancel

Third Eye Cinematics LLC reserves the right to cancel or reschedule the Masterclass for any reason, including but not limited to:

  • Low registration numbers making the event economically unviable.
  • Unforeseen unavailability of the guest speaker, Mr. Ravi Varman, due to professional commitments, illness, travel restrictions, or force majeure.
  • Acts of God, weather emergencies, or venue issues.

3.3. Refund Eligibility

In the event of a cancellation by the Organizer, Participants will receive a 100% refund of the registration fee paid to Third Eye Cinematics LLC.

3.4. Limitation of Liability (Travel & Expenses)

Strictly No Reimbursement for Personal Expenses:

The Organizer's liability is strictly limited to the refund of the Masterclass registration fee. Third Eye Cinematics LLC will not be liable for, and will not reimburse, any personal expenses incurred by the Participant in connection with the event. This includes, but is not limited to:

  • Airfare, train, or bus tickets (refundable or non-refundable).
  • Hotel or Airbnb accommodations.
  • Car rentals or transportation costs.
  • Lost wages or time off work.

Recommendation: We strongly advise all out-of-town participants to purchase comprehensive travel insurance that covers event cancellations.

4. Workshop Schedule & Content

We reserve the right to:

  • Modify workshop schedule, curriculum, or instructors as needed
  • Cancel the workshop due to insufficient enrollment (minimum 50 participants)
  • Change venue within the New York metropolitan area with 14 days notice

5. Age Requirement

Participants must be 18 years or older. Participants under 18 must be accompanied by a parent or legal guardian who has also registered for the workshop.

6. Intellectual Property & Recording Policy

6.1. Strict No-Recording Rule

To protect the intellectual property of the guest speaker and the commercial interests of the Organizer, Participants are strictly prohibited from recording any portion of the Masterclass. This includes:

  • Audio recording.
  • Video recording (including smartphone clips).
  • Live-streaming to social media (Instagram, Facebook, YouTube, etc.).

6.2. Copyright & Ownership

All content shared during the Masterclass, including presentation slides, handouts, and the spoken insights of Mr. Ravi Varman, remains the intellectual property of the speaker and/or Third Eye Cinematics LLC.

6.3. Penalty for Violation

Any Participant found violating this policy may be asked to delete the footage immediately and/or be removed from the venue without a refund. Third Eye Cinematics LLC reserves the right to pursue legal action for damages if proprietary content is published online.

6.4. Personal Use Rights

You retain rights to work created during the workshop for personal use only - no reproduction or distribution without written permission.

7. Media Release (Use of Likeness)

The Participant acknowledges that Third Eye Cinematics LLC may film or photograph the session for archival, promotional, and marketing purposes. By attending, the Participant grants Third Eye Cinematics LLC the irrevocable right to use their image, likeness, and voice in future marketing materials (website, social media, brochures) without compensation or further approval.

8. Disclaimer Regarding Guest Speaker

The Participant acknowledges that the guest speaker, Mr. Ravi Varman, is a working professional in the film industry. While his attendance is confirmed, the nature of the film industry involves unpredictable schedule changes. In the unlikely event of his absence, the cancellation policy in Section 3 will apply.

9. Code of Conduct

Participants must maintain professional behavior. We reserve the right to remove any participant who:

  • Disrupts the learning environment
  • Engages in harassment or discrimination
  • Violates venue rules or safety protocols
  • No refund will be provided for removal due to misconduct

10. Force Majeure

We are not liable for failure to perform due to circumstances beyond our control, including natural disasters, pandemics, government restrictions, or venue unavailability. In such cases, we will offer rescheduling or full refund.

11. Account Registration & Security

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • You agree to notify us immediately of any unauthorized access to your account
  • We reserve the right to suspend or terminate accounts that violate these terms
  • You may delete your account at any time by contacting us

12. Electronic Communications

By creating an account, you consent to receive electronic communications from us, including:

  • Account-related emails (verification, password reset, security alerts)
  • Workshop updates and important announcements
  • Marketing communications (you can opt out at any time)

These electronic communications satisfy any legal requirement for written communications.

13. General Liability Waiver

The Participant assumes all risks associated with attending the Masterclass. Third Eye Cinematics LLC, its owners, employees, and the guest speaker shall not be held liable for any personal injury, property damage, or theft occurring at the event venue.

14. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount you paid for the workshop
  • We are not liable for indirect, incidental, or consequential damages
  • We do not guarantee specific results from attending the workshop
  • As stated in Section 3.4, we are not liable for any personal expenses incurred in connection with the event

15. Dispute Resolution

Any disputes arising from these terms will be resolved through:

  • First, informal negotiation for at least 30 days
  • If unresolved, binding arbitration under the American Arbitration Association rules
  • You waive your right to participate in class action lawsuits

16. Governing Law

These terms are governed by the laws of the State of North Carolina, USA, without regard to conflict of law principles. Any legal proceedings shall be conducted in Wake County, North Carolina.

17. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
